WriteUp Demonstration Terms of Use

AutoPivot Pty Ltd ABN 39 701 217 745, of 30-32 Anstey Street, Albion, Queensland 4010, Australia

1. Application and acceptance

1.1 These terms govern use of the demonstration feature made available on our website (the Demo). They are separate from the WriteUp Terms and Conditions, which govern the subscription service (the Service).

1.2 By submitting a document to the Demo you accept these terms. If you do not accept them, do not submit a document.

1.3 No account, registration or payment is required to use the Demo. Use of the Demo does not create a subscription, an account, or any entitlement to the Service, and does not oblige us to supply the Service to you.

1.4 If you subsequently subscribe to the Service, the Terms and Conditions govern that subscription from the time it is taken out, and these terms cease to apply to your use of the Service.

1.5 You must be at least 18 years of age to use the Demo.

2. Scope of the Demo

2.1 The Demo is made available in two stages. The preview presented on our landing page returns output in respect of a single job recorded on the document, being the first job of a repair or diagnostic nature for which technician notes are identified. The full repair order preview returns output in respect of every job recorded on the document, and producing it requires the document to be processed again. Each stage returns digitised technician notes, a customer ready summary, the extracted header information described in clause 2.2, and one or more Note Excerpts, in each case in respect of the jobs covered by that stage.

2.2 Of the header information appearing on a repair order, the Demo extracts the repair order number, the vehicle type, and the first seven characters of the vehicle identification number. It does not extract the name of the vehicle owner, and it does not extract the eighth or any subsequent character of the vehicle identification number. Those are redacted at the point of extraction and are not stored.

2.3 The first seven characters of a vehicle identification number identify the manufacturer and describe the general characteristics of the vehicle. They do not include the vehicle identifier section, being the final eight characters, which carries the serial number unique to a particular vehicle. The characters extracted by the Demo therefore do not identify a particular vehicle.

2.4 A Note Excerpt is an image of the region of a submitted document containing the technician notes, returned so that you may compare the output against the document from which it was produced. Note Excerpts are provided in respect of technician notes only.

2.5 The redaction described in clause 2.2 operates at the point of extraction and is confined to the fields it names. It does not operate on the digitised technician notes, on the customer ready summary, or on a Note Excerpt. Where the name of a person, a telephone number, a registration number, a signature or other identifying information appears in the body of the technician notes, it may appear in the digitised notes and in the summary, and a Note Excerpt reproduces that region of the document as it was written.

2.6 The accuracy of output produced by the Demo depends on the quality of the document submitted. Output produced from the sample document is not an indication of the output that will be produced from a document of your own.

2.7 The Demo is made available for evaluation only. It is not made available for use in your business, and output produced by the Demo must not be relied upon or used in your business.

3. Submission of documents

3.1 A sample document is made available for use with the Demo, and we recommend that you use it. The sample document was prepared by us, and the output shown for it was produced in advance rather than at the time of your visit.

3.2 You may submit your own document. If you do, you warrant that you are entitled to disclose it to us for processing under these terms, and that you have the authority of each person whose information appears in it.

3.3 We ask that you do not submit a document containing the personal information of another person. Where you choose to submit your own document, we recommend that you obscure the name, contact details and registration details of any other person, and any handwritten signature, before doing so. Where you do not, clause 3.2 applies and you are responsible for that disclosure.

3.4 You must not submit to the Demo:

(a) payment card numbers, card verification values, or other cardholder data;

(b) government identity document numbers;

(c) health information or other sensitive information within the meaning of the Privacy Act 1988 (Cth);

(d) material that infringes the rights of a third party or that is unlawful; or

(e) material containing malicious code.

3.5 We may refuse to process any document, and may reject a document by reference to its size, format, or content, without giving a reason.

4. Retention and use of submissions

4.1 We do not retain the file you submit to us. It is processed and then discarded. This clause is subject to clause 4.2, under which a Note Excerpt taken from the file is retained, and to clause 4.6, which describes the copy of the file held in your browser.

4.2 The output returned to you in respect of a document you submit (Demo Output) is retained for up to 24 hours so that the result remains available to you during your visit, after which it is deleted. Demo Output comprises the digitised technician notes, the customer ready summary, the extracted header information, and any Note Excerpt, in each case in respect of the jobs covered by the stage of the Demo you have used. Demo Output does not include the information redacted under clause 2.2, which is not extracted. Demo Output may otherwise contain information identifying an individual, where that information appears in the body of the document submitted. Where you move from the first stage of the Demo to the second, the document is processed again and a second Demo Output is created, which is retained for its own period of up to 24 hours. This clause does not apply to the sample document, for which the output shown is produced in advance under clause 3.1 and no output is created or retained in respect of your visit.

4.3 Demo Output is encrypted at rest. The key is generated for your session and is held in your browser. Because decryption is carried out on our servers, the key is transmitted to us with each request in which it is required. We do not retain the key after the request in which it is used, we do not store it with Demo Output, and we take reasonable steps to prevent it being recorded in our logs. The effect of this clause is that Demo Output is protected against disclosure of the storage in which it is held. It does not place Demo Output beyond our reach.

4.4 We apply limits to the number of submissions that may be made to the Demo, and a separate limit applies to the full repair order preview. In order to apply those limits and to identify and prevent misuse, we collect and retain a record comprising the internet protocol address from which a submission is made, an identifier stored on your device, a device identifier, and the date, time and outcome of the submission (Abuse Record). Where the Demo is used through a mobile application, we may in addition use the device attestation or device integrity facilities made available by the operating system platform for the same purpose. We retain the Abuse Record for 30 days from the date of submission, after which it is deleted.

4.5 The identifiers described in clause 4.4 are used only for the purposes stated in that clause. They are separate from the key described in clause 4.3. We do not use them for advertising, analytics or marketing, we do not disclose them to an advertising or analytics provider, and we do not use the advertising identifier made available by a mobile operating system platform for any purpose connected with the Demo.

4.6 In order to display a thumbnail of the document you have submitted, and to allow the full repair order preview to be produced without a further upload, a copy of that document is held in your browser, in memory and in session storage, for the duration of your session. It is cleared when the browser tab is closed. The thumbnail is generated in your browser. Neither the copy of the document held under this clause nor the thumbnail is transmitted to us, including to any analytics or error reporting facility.

4.7 We do not use any document submitted to the Demo, or any Demo Output, to train, fine tune, or evaluate any model, whether ours or a third party's. That applies without qualification.

4.8 Clauses 4.1 to 4.6 do not prevent us from retaining or disclosing material where we are required to do so by law, or where it is necessary to investigate a suspected offence or to respond to a request from a law enforcement agency.

4.9 Demo Output is made available at an address specific to your submission. That address alone does not give access to Demo Output, which cannot be read without the key described in clause 4.3. You should nonetheless not share the address with any person.

5. Status of Demo Output

5.1 Demo Output is produced by automated means. It is an interpretation of the document submitted. It is not a certified transcription and it is not a verified account of work performed.

5.2 Demo Output may contain errors, omissions and mistranscriptions, and may include statements not supported by the document submitted.

5.3 You must not rely on Demo Output. In particular you must not send the customer ready summary to a vehicle owner, communicate Demo Output to any other person, enter it into a dealer management system, or use it in connection with a warranty claim, an insurance claim, a record keeping obligation, or a legal proceeding.

5.4 The Demo does not provide technical, diagnostic, safety, legal, financial or professional advice. Demo Output must not be used to determine the roadworthiness or safety of a vehicle.

6. Acceptable use

6.1 The number of submissions that may be made to the Demo is limited, and a separate limit applies to the full repair order preview. We set those limits and may change them at any time.

6.2 You must not:

(a) use the Demo other than to evaluate the Service;

(b) submit documents to the Demo by automated means, or in bulk;

(c) circumvent or attempt to circumvent a submission limit, a rate limit, or any other control;

(d) use the Demo, or Demo Output, to develop, train or improve a machine learning model, or to develop a product that competes with the Service;

(e) benchmark the Demo for publication without our prior written consent;

(f) use the Demo to perform optical character recognition or data extraction for a purpose other than evaluating the Service; or

(g) interfere with the integrity, security or performance of the Demo, or attempt to obtain unauthorised access to it or to the submissions of any other person.

6.3 We may block access to the Demo, from an internet protocol address or otherwise, without notice and without giving a reason.

7. Availability and withdrawal

7.1 The Demo is provided without any commitment as to availability. It may be unavailable, may fail to return a result, and may be changed, suspended or withdrawn at any time without notice.

7.2 We are under no obligation to return Demo Output, to return it within any period, or to preserve it.

8. Privacy

8.1 We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy.

8.2 Where you submit your own document to the Demo, we handle any personal information in it on our own account and not on behalf of any other person. This is different from the position under the Service, where we handle such information on the instructions of the subscriber.

9. Warranties and liability

9.1 The Demo is provided as is and as available. Subject to clause 9.2, and to the maximum extent permitted by law, we exclude all conditions, warranties, guarantees, representations and terms implied by statute, general law or custom, including any as to accuracy, completeness, fitness for a particular purpose and non-infringement.

9.2 Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy conferred by the Australian Consumer Law or by any other law where to do so would be unlawful.

9.3 Subject to clause 9.2, and to the maximum extent permitted by law, we are not liable to you for any loss or damage arising out of or in connection with the Demo, whether in contract, in tort including negligence, under statute or otherwise, and including any loss arising from reliance on Demo Output.

9.4 You acknowledge that the Demo is supplied at no charge and that the allocation of risk in this clause reflects that.

10. Intellectual property

10.1 We own all intellectual property rights in the Demo and in the sample document, and nothing in these terms transfers any of those rights to you.

10.2 You retain all rights in a document you submit. You grant us a licence to process it for the purpose of operating the Demo, which ends when the document is discarded under clause 4.1.

11. Changes to these terms

11.1 We may change these terms at any time by publishing amended terms. The terms in force at the time of a submission govern that submission.

12. General

12.1 These terms are governed by the law of Queensland, Australia, and each party submits to the non-exclusive jurisdiction of the courts of that State. Where you are a consumer resident in a jurisdiction whose law confers a right to bring proceedings in local courts or to the benefit of local mandatory consumer law, this clause does not deprive you of that right.

12.2 If a provision of these terms is void, voidable or unenforceable, it is severed to the extent necessary and the remainder continues in force.

12.3 These terms are the entire agreement between us in relation to the Demo.
